Terms of Use

These Terms of Use ("Terms") are an agreement between you and Amote ("we", "us") covering your use of the Perfo mobile app and this website (together, "Perfo"). By downloading or using Perfo you accept these Terms. If you don't accept them, please don't use Perfo.

1. Using Perfo

We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use Perfo on devices you own or control, for your own personal, non-commercial use, in line with these Terms and the Google Play Terms of Service.

If you are under the age of majority where you live, you may use Perfo only with the permission of a parent or guardian.

2. Your content

"Your content" means the photos you take or import, the stamps and boards you create, and the notes you write. You keep all ownership of your content. Because it's stored only on your device, we never receive it and we don't need any licence to it.

You are responsible for your content and for making sure you have the right to use any photo you turn into a stamp — especially photos of other people or of works owned by someone else.

3. Acceptable use

You agree not to use Perfo to:

• create or share content that is illegal, harassing, hateful, sexually exploitative of minors, or that invades someone's privacy;
• infringe anyone's copyright, trademark or other rights;
• make images that imitate real postage stamps, postmarks or official documents in order to deceive anyone or to be used as real postage;
• copy, modify, reverse engineer or redistribute the app, except where the law expressly allows it;
• interfere with the app's operation or try to get around its security.

Stamps made in Perfo are decorative images. They have no postal value and can't be used to send mail.

4. Our content

The Perfo name, logo, mascot, frame designs, postmark artwork, app code and this website belong to Amote and are protected by intellectual property laws. You may share stamps and boards you made with Perfo, including the frames and postmarks on them, for personal use. You may not use our name or artwork to brand your own product.

5. Location and dates on stamps

Place names come from your device's location services and Android's geocoder, and dates come from your phone's clock. They may occasionally be inaccurate or missing. Don't rely on a stamp as proof of when or where something happened.

6. Backups and data loss

Your collection is stored only on your device. Uninstalling the app, clearing its storage, resetting or losing your phone may permanently delete your stamps and boards. We don't keep copies and can't recover them. Save the stamps you care about to your gallery or another backup.

7. Third-party services

Perfo relies on services from Google (Google Play, Google Play services and Firebase) and on the apps you choose to share to. Your use of those services is governed by their own terms. We aren't responsible for them. See our Privacy Policy for what data these services receive.

8. Updates and changes

We may update Perfo to add, change or remove features, and we may stop offering it at any time. If we stop, the version on your phone may keep working, but we're not obliged to keep supporting it.

We may also update these Terms. When we do, we'll change the effective date above, and for significant changes we'll tell you in the app or on the Google Play listing. Continuing to use Perfo after a change means you accept the updated Terms.

9. Disclaimer

Perfo is provided "as is" and "as available". To the fullest extent the law allows, we make no warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement, and we don't promise that the app will be error-free, uninterrupted or free of data loss.

10. Limitation of liability

To the fullest extent the law allows, Amote will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, photos, memories, profits or goodwill, arising from your use of or inability to use Perfo. Our total liability for any claim related to Perfo is limited to the amount you paid us for the app in the twelve months before the claim, or USD 10 if you paid nothing.

Some countries don't allow these limits, so some of them may not apply to you. Nothing in these Terms limits rights you have as a consumer that can't be waived by contract.

11. Ending these Terms

You can stop using Perfo at any time by uninstalling it. We may suspend or end your licence if you seriously or repeatedly break these Terms. Sections 2, 4, 6, 9, 10 and 12 continue to apply after the Terms end.

12. Governing law

These Terms are governed by the laws of Vietnam, without regard to conflict-of-law rules. Any dispute will be handled by the competent courts of Vietnam, unless the consumer laws of your country of residence give you the right to bring a claim where you live.
